These Terms govern your access to and use of Hard Hat Tradie. Please read them carefully before using the platform.

1. Introduction

1.1 These Terms and Conditions (“Terms”) govern access to and use of the Hard Hat Tradie platform, including our website, web applications, APIs and related services (together, the “Platform”).

1.2 By accessing, registering for or using the Platform, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1.3 The Platform is operated by MMC ORBIT LTD (“we”, “us” or “our”). We provide an online construction job board and industry platform connecting individuals and businesses. Unless expressly stated otherwise, we are not an employer, employment agency, recruiter, contractor, subcontractor, principal, broker or party to any agreement between users.

2. Nature of the Platform

2.1 The Platform enables users to create profiles, publish and search job advertisements, express interest in opportunities and make industry connections for employment, recruitment, subcontracting, apprenticeships and business opportunities.

2.2 Any employment, engagement, contract or other arrangement entered into between users is made at their own discretion and risk and exists solely between the relevant parties.

2.3 Unless a feature is expressly described as verified, we do not independently verify, vet, certify, guarantee or endorse users; confirm qualifications, licences, tickets, references, insurance or legal compliance; supervise or direct work; or negotiate and administer contracts between users.

2.4 We do not guarantee the quality, legality, safety, suitability or outcome of any work, service, vacancy, candidate or agreement found through the Platform.

3. Eligibility and Accounts

3.1 You must be at least 16 years old to register for or use the Platform. Users aged 16 or 17 must have permission from a parent or legal guardian and must use the Platform only for lawful, work-related purposes.

3.2 You must provide accurate, current and complete information and keep your account details up to date.

3.3 You are responsible for protecting your login credentials and for activity carried out through your account. You must notify us promptly if you suspect unauthorised access or misuse.

3.4 We may refuse registration or suspend, restrict or terminate an account where we reasonably believe these Terms have been breached, the Platform has been misused or action is required for legal, security or operational reasons.

4. Job Advertisements, Profiles and Applications

4.1 Employers and recruiters are responsible for ensuring that advertisements are accurate, lawful, genuine, non-discriminatory and relate to real opportunities they are authorised to advertise.

4.2 Candidates and other users are responsible for the accuracy of profiles, CVs, qualifications, experience, tickets, availability and other information they provide.

4.3 Users must carry out their own checks before offering or accepting work, including identity, right-to-work, qualification, reference, insurance, health and safety and contractual checks where relevant.

4.4 We may edit formatting, reject, suspend or remove advertisements or profiles that are misleading, duplicated, expired, unlawful, inappropriate or inconsistent with these Terms.

5. Fees, Subscriptions and Payments

5.1 Some features are subject to fees, subscriptions or charges displayed at the point of purchase. You agree to pay all applicable charges and taxes.

5.2 Unless expressly stated otherwise or required by law, fees are non-refundable once the relevant service or advertising period has begun.

5.3 Subscription terms, renewal arrangements and cancellation options will be displayed at purchase. We may change future pricing or plans on reasonable notice.

5.4 Payments may be processed by third-party payment providers and are also subject to their terms. We are not responsible for outages or errors outside our reasonable control.

7. Platform Availability and Results

7.1 The Platform is provided on an “as is” and “as available” basis. We may change, suspend or withdraw features where reasonably necessary.

7.2 We do not guarantee uninterrupted availability, complete accuracy or that using the Platform will result in employment, candidates, applications, contracts or business opportunities.

7.3 Job advertisements and user content are supplied by third parties. We are not responsible for decisions made by employers, recruiters, candidates or other users.

8. Intellectual Property and User Content

8.1 The Platform and its branding, software, design and original content are owned by or licensed to MMC ORBIT LTD and are protected by intellectual property law.

8.2 You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, display, format and otherwise use that content as reasonably necessary to operate, secure and promote the Platform.

8.3 You confirm that you have the right to submit your content and that it does not infringe another person’s rights. We may remove content that breaches these Terms.

9. Data Protection

9.1 We process personal data as described in our Privacy Policy.

9.2 Users who receive personal information through the Platform must use it lawfully, securely and only for the purpose for which it was provided.

10. Limitation of Liability

10.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

10.2 Subject to clause 10.1, we are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, contracts, goodwill or data arising from use of the Platform or dealings between users.

10.3 We are not responsible for the acts or omissions of users or third parties, or for events outside our reasonable control.

11. Disputes Between Users

Any dispute arising from an employment, recruitment, subcontracting or business arrangement is the responsibility of the parties involved. We are not obliged to mediate or determine such disputes, although we may investigate reported misuse of the Platform.

12. Suspension and Termination

We may suspend or terminate access where necessary to protect users or the Platform, comply with law, investigate suspected misuse or enforce these Terms. Termination does not affect accrued rights or obligations and does not create a right to a refund except where required by law or expressly agreed.

13. Changes to These Terms

We may update these Terms from time to time. We will publish the revised version and update the date above. Where a change is material, we will provide reasonable notice where practicable. Continued use after the revised Terms take effect constitutes acceptance.

14. General

14.1 We are not liable for delay or failure caused by events beyond our reasonable control.

14.2 Third-party links are provided for convenience only. We are not responsible for third-party websites or services.

14.3 If any provision is held unenforceable, the remaining provisions continue in force. Failure to enforce a provision is not a waiver.

14.4 These Terms and the Privacy Policy constitute the entire agreement between you and us concerning the Platform.

15. Governing Law and Contact

15.1 These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory consumer rights that apply.
